What Should a Foreign Tourist Do After a Hotel Accident in Turkey?

A hotel accident in Turkey may involve a swimming pool, wet floor, elevator, balcony, restaurant, bathroom, spa or another part of the accommodation. The steps taken immediately after the incident may affect the availability of evidence, but personal safety and medical care should come first.

Obtain Medical Assistance

The injured guest should consider obtaining appropriate medical examination and treatment. Even where an injury initially appears minor, medical records may help document its nature, timing and development.

The guest should retain:

  • Medical reports and discharge documents;
  • X-rays, scans and test results;
  • Prescriptions and medication records;
  • Hospital, transport and treatment invoices;
  • Subsequent medical records obtained after returning home.

Report the Accident in Writing

The incident should, where possible, be reported to hotel management in writing. The guest may request a copy of the hotel’s incident report and should retain emails, messages and other correspondence.

A document should not be signed unless its content is understood. If it is provided only in Turkish, requesting a translation or keeping a copy for later review may be appropriate.

Preserve Evidence

Depending on the circumstances, useful evidence may include:

  • Photographs and videos of the accident area;
  • Warning signs, defects and surrounding conditions;
  • Witness names and contact details;
  • CCTV and electronic access records;
  • Booking and package holiday documents;
  • Travel insurance information;
  • The legal name of the company operating the hotel.

CCTV footage and internal records may not be retained indefinitely. A timely written request for their preservation may therefore be useful.

Who Should Be Notified?

Depending on the booking arrangements, the guest may consider notifying the hotel, travel insurer, tour operator or package travel organiser. Notification does not itself prove responsibility, but it may create a contemporaneous record.

A foreign tourist who has already returned home may still request an assessment. Jurisdiction, applicable law, the responsible party and available remedies depend on the individual facts.
