Hotel Swimming Pool Accidents in Turkey

Swimming pool accidents are among the risks foreign guests may encounter at hotels and holiday resorts in Turkey. These incidents may involve slipping on wet surfaces, defective pool equipment, inadequate depth markings, water slides, broken tiles, poor water quality or delayed emergency assistance.

An accident occurring at a hotel does not automatically establish the hotel’s legal liability. Responsibility generally depends on the circumstances, including whether a dangerous condition existed, whether reasonable precautions were taken and whether that condition contributed to the injury.

Who May Be Responsible?

Depending on the booking and operation of the facility, potentially relevant parties may include:

  • The hotel operator or property owner;
  • A company responsible for pool maintenance;
  • A water-slide or equipment operator;
  • A tour operator or package travel provider;
  • An insurer or another contracted service provider.

The appropriate party cannot be determined solely from the hotel’s commercial name. The operating company, reservation documents and contractual relationships may need to be examined.

Evidence to Collect

A foreign guest involved in a pool accident should, where safely possible, preserve:

  • Photographs and videos of the pool and surrounding area;
  • Warning signs and depth markings;
  • Witness names and contact details;
  • Written incident reports submitted to the hotel;
  • Hospital records, medical reports and invoices;
  • Booking and package holiday documents;
  • Details of any available CCTV footage.

Evidence may later be lost or overwritten. A prompt written request to preserve relevant records may therefore be useful.

Turkish law may become relevant where an accident occurs in Turkey. However, jurisdiction, applicable law and the identity of any responsible party require an individual assessment. The injured person’s conduct and compliance with safety warnings may also be considered.
