Hotel Balcony Falls in Turkey

Falls from hotel balconies can result in severe injury or death. Such incidents may involve the height or condition of a railing, climbable features, furniture positioned near the balcony edge, structural failure, inadequate lighting or individual conduct.

A balcony fall occurring at a hotel does not automatically establish the hotel’s legal liability. The design and condition of the balcony, applicable safety requirements, maintenance history and circumstances immediately preceding the fall may all require examination.

Factors That May Be Relevant

Depending on the incident, a legal and technical assessment may consider:

  • The height, spacing and structural condition of the railing;
  • Whether parts of the railing could be climbed;
  • The position of chairs, tables or other furniture;
  • Loose components, corrosion or previous repairs;
  • Lighting and access to the balcony;
  • Whether children could access the balcony without supervision;
  • Previous complaints or similar incidents;
  • The conduct of the person who fell.

Alcohol consumption or risky conduct may be relevant to the assessment. However, it does not necessarily determine the entire question of responsibility without considering the other circumstances.

Evidence After a Balcony Fall

Relevant evidence may include:

  • Photographs and measurements of the balcony and railing;
  • Images showing furniture placement and structural damage;
  • CCTV footage and electronic room-access records;
  • Witness and hotel staff statements;
  • Emergency service, police and hotel incident records;
  • Maintenance, renovation and inspection documents;
  • Medical records, invoices or post-mortem documents;
  • Reservation and package travel documents.

The balcony may be repaired or altered after the incident. Promptly preserving photographs, footage and technical records may therefore be important.

Depending on the evidence, the hotel operator, property owner, construction or maintenance contractor, tour provider or another party may require examination. Determining causation and responsibility may require expert evidence.
