Legal Update: Turkish Timeshare Regulation Amended – Minimum Period Now Set to 7 Days

A recent amendment to Turkish property law has brought a clear framework to the minimum period of timeshare rights (“devre mülk”). As of the latest legal update (Law No. 3227, added to the Condominium Law), a timeshare right must now be allocated for a minimum duration of 7 days. What is a Timeshare (Devre Mülk) in Turkish Law?

A timeshare, known as devre mülk in Turkish legislation, is a type of property right where multiple individuals share ownership of a real estate unit, each having the right to use it exclusively for a specific time during the year.

Under Article 59 of the Condominium Law (Kat Mülkiyeti Kanunu), a valid timeshare must:

  • Be based on a real property with independent section status (such as an apartment unit or villa),

  • Be allocated for specific time periods within the year,

  • Not be shorter than 7 days per use period, as per the latest amendment.


Legal Nature of Timeshare Rights

Timeshare is a limited real right (sınırlı ayni hak), formally registered in the land registry. It is transferable, inheritable, and may be sold or leased like other immovable rights, though subject to special regulations.


Can Foreigners Buy Timeshare in Turkey?

Yes, foreign individuals and legal entities can acquire timeshare rights in Turkey, subject to general restrictions on foreign ownership. The same title deed procedures apply, and timeshares must be properly registered to gain full legal protection.
